SUBJECT:
Consideration and possible action to approve a resolution for the  annexation of approximately 0.761 acres of City-owned right-of-way situated in part in the Francis A. Hudson Survey, Abstract No.295; directing initiation of annexation proceedings; and directing publication of notice for proposed annexation (2021-19-ANX) -- Sofia Nelson, Planning Director
ITEM SUMMARY:

The W.D. Kelley Foundation, as the owner of the property located at 5501 S IH 35, Georgetown, TX 78626, a 92.23-acre tract of land described by metes and bounds and sketch attached  as Exhibit “A”, has filed a written request with the City of Georgetown (the “City”) for annexation of the Property, identified as Annexation Case No. 2021-19- ANX ("Annexation Case").

 

The City owns 0.761 acres of adjacent right-of-way, situated between the Property and the County-maintained right-of-way of Rabbit Hill Road, described in a Special Warranty Deed from the W.D. Kelley Foundation to the City recorded in Document No. 2009053424 of the Official Public Records of Williamson County, Texas and by metes and bounds and sketch attached as Exhibit “B”.

 

If the City of Georgetown annexes the City RoW as part of the Annexation Case, the City must annex the immediately adjacent right-of-way of Rabbit Hill Road as part of the Annexation Case, in accordance with Section 43.106 of the Texas Local Government Code, and may annex all of the adjacent right-of-way of Rabbit Hill Road currently maintained by Williamson County, from approximately 282 feet south of Lookout Ridge to the intersection of Westinghouse Road as described and depicted in Exhibit “C” attached hereto and incorporated herein (the “County RoW”), in accordance with Section 43.1056 of the Texas Local Government Code.

 

This resolution directs city staff to initiate annexation proceedings of the City RoW in conjunction with the annexation of Annexation Case, as well as the entire County RoW.

FINANCIAL IMPACT:
Applicant is the City, therefore application fees do not apply.
