SUBJECT:

Consideration and possible action to approve an Easement Amendment with Wolf Lakes, LP. to allow the installation of gas lines within the electric easement granted to the City in Document No. 2022043501, and to authorize the Mayor to execute the same -- Jim Kachelmeyer, Assistant City Attorney

ITEM SUMMARY:

In spring of 2022, Wolf Lakes, LP. granted the City of Georgetown an exclusive Electric Easement to serve the new HEB development in Wolf Lakes. 

 

Wolf Lakes, LP is now looking to provide gas service to the project and wishes to utilize the same utility corridor.  Wolf Lakes, LP proposes to place the gas facilities 28 inches above the City’s electrical facilities in the same trench, in accordance with approved City specifications often used in public utility easements.  Any gas provider who wants to install its facilities in the approved location would need to seek a license to encroach from the City, so that the plans may be reviewed by appropriate staff. These terms are consistent with what those of the City's easement agreement with HEB.

 

Co-locating the utilities in this way would leave greater remaining developable area, to increase the density of the proposed Wolf Lakes Village development, in furtherance of the PUD and the TIRZ approved for the area.  Thus, Staff recommends approval of this Easement Amendment.

FINANCIAL IMPACT:
No immediate cost to the City.  Wolf Lakes LP will pay the cost to record the easement amendment.  Potential increase in future maintenance costs for the electric facilities, due to difficulty to access below the gas lines.
