SUBJECT:
Consideration and possible action to approve an Interlocal Cooperation Agreement for Water Supply Facilities, including a Partial Assignment of Easement for Water Facilities, with Brushy Creek Municipal Utility District, for the Parkside Waterline project, and to authorize the Mayor to execute all necessary documents -- Jim Kachelmeyer, Assistant City Attorney; Wes Wright, Systems Engineering Director
ITEM SUMMARY:
In 2020, the City Council approved an interlocal cooperation agreement with the City of Round Rock for the supply of treated water to Georgetown in times of peak demand.  The supply will provide the City with additional capacity to serve Georgetown Water customers as the new South Lake Water Treatment Plant is under construction.

To obtain the treated water from the City of Round Rock, the City plans to construct a water line from a point near the intersection of County Road 175 and FM 1431 via a route through Southwest Williamson County Regional Park, the Parkside at Mayfield Ranch subdivision, and Parkside on the River subdivision, eventually connecting with the City’s system.  Easements and licenses have been or are being obtained from the City of Round Rock, Leander ISD, and the private developments along the route.  The last major missing piece of the preferred route is an easement through Southwest Williamson County Regional Park.

In an effort to avoid disruption to the park, the proposed water line will parallel an existing raw water line owned and operated by the Brushy Creek Municipal Utility District (BCMUD), along the route shown on the attached map.  BCMUD’s existing easement rights include the right to construct a second line, parallel to its first line, but BCMUD has no intention of constructing such a line in the near future.

Accordingly, City Staff and BCMUD have agreed, subject to Council approval, that BCMUD shall assign to the City its rights within its existing easement to construct a second line, and the City shall have the right to install and operate its line within the easement area for a period of fifteen years, plus a five-year extension option.  At the conclusion of the assignment term, after completion of the City’s South Lake Water Treatment Plant, the City will relinquish the easement rights—and the facilities—back to BCMUD for its future use.  

Staff recommends approval of the attached Interlocal Cooperation Agreement with BCMUD for the assignment from BCMUD to the City of some of its easement rights within Southwest Williamson County Regional Park for a period of up to 20 years. The BCMUD Board approved the Interlocal Cooperation Agreement and the Partial Assignment of Easement for Water Facilities at its August 26, 2021 meeting.
 
FINANCIAL IMPACT:
No impact associated with the assignment of the easement rights.  Any costs to the City associated with the construction of the water line or the future relinquishment of the facilities, will be addressed within a future Council approval of the project.
