Consideration and possible action to approve six license agreements with Berry Creek (Georgetown) ASLI IX, LLC, for the placement of landscaping and trees within the right-of-way of BCH Way, a public right-of-way within Phase 1A of the Berry Creek Highlands subdivision, and to authorize the Planning Director to execute the same -- Jim Kachelmeyer, Assistant City Attorney
ITEM SUMMARY:
In May 2020, Berry Creek (Georgetown) ASLI IX, LLC, recorded a final plat of Phase 1A of the Berry Creek Highlands subdivision, which dedicated right-of-way to the City for the construction of BCH Way. The construction of BCH Way is complete, and the City accepted the dedication of the right-of-way on June 11, 2021.  As part of its construction of Berry Creek Highlands, Berry Creek (Georgetown) ASLI IX, LLC would now like to install enhanced landscaping and trees within portions of BCH Way. 

Accordingly, in accordance with Chapter 12.09 of the City’s Code of Ordinances and Chapter 3.21 of the Unified Development Code, attached for Council’s review and approval are six separate license agreements for the encroachment of the enhanced landscaping into the right-of-way of BCH Way. The agreements are the City’s standards terms, albeit with additional tree trimming and planting obligations placed upon the Licensee, so as to maintain sight visibility for vehicles and pedestrians within the neighborhood.

Staff recommends approval of all six license agreements, as modified
