SUBJECT:

Second Reading of an Ordinance on a request for a Zoning Map Amendment to rezone 0.662 acres of property described as Lots 1, 2, 7, and 8, Block 12, North Georgetown Addition, from the Residential Single-Family (RS) district to the Low Density Multi-Family (MF-1) district, for the property generally located at 806 E. Spring Street (2021-8-REZ) -- Sofia Nelson, Planning Director

ITEM SUMMARY:

Overview of Applicant’s Request:
The applicant is requesting rezoning of the subject property to facilitate the development of a community of compact cottage style residential homes. The proposal includes 6 buildings that are 2 stories each with 2 one-bedroom units in each, along with 1 building that is 2 stories and includes 1 unit with two bedrooms for a total of 13 units proposed. The rezoning request is to amend the properties zoning designation from the Residential Single-Family (RS) zoning district to the Low Density Multi-Family (MF-1) zoning district.

Staff’s Analysis:

 Staff has reviewed the request in accordance with the Unified Development Code (UDC) and other applicable codes. Staff has determined that the proposed request meets 4 of 5 and partially meets 1 of 5 of the criteria established in UDC Section 3.06.030 for a rezoning, as outlined in the attached Staff Report.

 

Public Comments:

As required by the Unified Development Code (UDC), all property owners and registered neighborhood associations within 300-feet of the subject property were notified of the request (25 notices mailed), a legal notice advertising the public hearing was placed in the Sun Newspaper May 30, 2021 and signs were posted on-site. As of the publication date of this report, staff has received 1 written comment in favor and 25 in opposition of the request (Exhibit 6).

 

Planning & Zoning Commission Action:

At their July 6, 2021 meeting, the Planning & Zoning Commission recommended Approval of the request (5-1-1).

 

City Council Action:

At their August 24, 2021 meeting, the City Council approved first reading of the ordinance (6-0).

 
FINANCIAL IMPACT:

None. The applicant has paid the required application fees.
