SUBJECT:

Second Reading of an Ordinance on a request for a Zoning Map Amendment to rezone a 146.786-acre tract of land out of the Woodruff Stubblefield Survey, Abstract No. 556, from Agriculture (AG) to Planned Unit Development (PUD) with a base district of Residential Single-Family (RS), Low Density Multifamily (MF-1) and General Commercial (C-3) for the property generally located northeast of the Sam Houston Ave and Bell Gin Road intersection -- Sofia Nelson, Planning Director

ITEM SUMMARY:

Overview of Applicant’s Request:

The Applicant requests to rezone the Property to Planned Unit Development (PUD) with a mix of RS – Residential Single Family, MF-1 – Low Density Multi-Family and C-3 – General Commercial base districts. The applicant states that the PUD establishes the framework for a mix of residential housing opportunities along with a mix of retail and office uses.

 

Staff Analysis:

Staff has reviewed the request in accordance with the Unified Development Code (UDC) and other applicable codes. Staff has determined that the proposed request complies 2 and partially complies with 3 of the 5 criteria, criteria established in UDC Section 3.06.030, for a Zoning Map Amendment, and partially complies with 5 and does not comply with 1 of the 6 criteria for a Planned Unit Development, as outlined in the attached Staff Report.

 

Public Notification:

As required by the Unified Development Code, all property owners and registered neighborhood associations within a 300-foot radius of the subject property were notified of the Zoning Map Amendment request (28 notices), a legal notice advertising the public hearing was placed in the Sun Newspaper (March 21, 2021) and signs were posted on-site. To date, staff has received 0 written comments in favor, and 0 in opposition to the request.

 

Planning and Zoning Commission Findings:

At their April 6, 2021 meeting, the Planning & Zoning Commission recommended approval of the request (5-2).

 

City Council Action on First Reading:

 At their April 27 meeting, the City Council approved the first reading of the ordinance (7-0).

 

Two Changes have been made to the PUD since the first reading:

  1. The Utility Section has been removed.  All Utility standards will be held to UDC requirements.
  2. At the request of City Council, the applicant has added the following language to the PUD: 

 

 Phasing

No more than 285 residential units shall be permitted through the building permit approval process prior to platting one (1) non-residential lot.  The non-residential lot shall be a minimum of three (3) acre lot with direct access to Patriot Way and/or the internal roadway network.  

FINANCIAL IMPACT:

None. The applicant has paid the required application fees.
