SUBJECT:

Second Reading of an Ordinance on a request for a Zoning Map Amendment to rezone Lots 1 and 2, Block 22, Glasscock Addition, from the Residential Single-Family (RS) zoning district to the Mixed-Use Downtown (MU-DT) zoning district, and from the Old Town Historic Overlay zoning district to the Downtown Historic Overlay zoning district, for the property generally located at 1004 S Church St -- Sofia Nelson, CNU-A, Planning Director

ITEM SUMMARY:

Overview of Applicant’s Request:

The applicant is requesting approval of a zoning map amendment (rezoning) to rezone the subject property from the Residential Single-Family (RS) zoning district to the Mixed-Use Downtown (MU-DT) zoning district, which also requires the subject property to be located within the Downtown historic zoning overlay district. The subject property is currently located within the Old Town historic zoning overlay district. The applicant is requesting this zoning change to be able to use the historic Jesse Daniel Ames House, the historic main structure on the subject property, as a day spa.

 

Staff’s Analysis:

Staff has reviewed the request in accordance with the Unified Development Code (UDC) and other applicable codes. Staff has determined that the proposed request meets 2 of the 5 criteria established in UDC Section 3.06.030 for a Zoning Map Amendment (Rezoning) and meets the criteria established in UDC Section 3.06.060 for a Historic Overlay District, as outlined in the attached Staff Report.

 

Public Comments:

As required by the Unified Development Code (UDC), all property owners and registered neighborhood associations within 300-feet of the subject property were notified of the request (21 notices mailed), a legal notice advertising the public hearing was placed in the Sun Newspaper on March 21, 2021 and signs were posted on-site. As of the publication date of this report, staff has received 0 written comments in favor and 2 in opposition to the request.

 

Historic and Architectural Review Commission Recommendation:

At their March 25, 2021 meeting, the Historic and Architectural Review Commission recommended approval (3-1) of the request.

 

Planning and Zoning Commission Recommendation:

At their April 6, 2021 meeting, the Planning and Zoning Commission recommended approval (4-3) of the request.

 

City Council First Reading:

At their April 27, 2021 meeting, the City Council approved (5-2) First Reading of the Ordinance for the proposed request.

FINANCIAL IMPACT:

None. The applicant has paid the required application fees.
